DOJ Sues CA Over New Law Protecting Discarded Net Neutrality Rules

Advocates of net neutrality hope California's law will push Congress to enact national rules or encourage other states to create their own.

"I favor a free and open internet as I think most consumers do, my concern is with the particular regulations the FCC adopted two years ago, my concern is that by imposing those heavy-handed economic regulations on internet service providers both big and small we could end up disincentivizing companies from wanting to build out internet access to a lot of parts of the country", stated Pai.

A hefty thank you to the Golden State for your effort to get right what the @FCC got so wrong when it rolled back open internet protections late previous year.

The neutrality law is the latest example of California, ground zero of the global technology industry, attempting to drive public policy outside its borders and rebuff President Donald Trump's agenda.

But the Justice Department said the law runs afoul of the U.S. Constitution, which gives the federal government the power to set rules for interstate commerce - and that, they said, means the internet. "While the Trump Administration does everything in its power to undermine our democracy, we in California will continue to do what's right for our residents".

California's new law, however, goes farther than even the old FCC rules did in placing restrictions on internet service providers.

Jerry Brown has signed into law the strictest set of net neutrality protections ever seen in the US.


California's law seeks to reinstate those rules.

After the governor's veto, Leyva said she will introduce the bill next session.

"This is a big day for net neutrality", said Robert Cruickshank, campaign director at the advocacy group Demand Progress.

"That preemption of the states, despite the federal government relinquishing regulation itself, was upheld by the courts", Martin said, adding that it still was an act of Congress itself.

Net neutrality vote: Why all the fuss?

Disregarding the clear popular support for such protections and showing its commitment to seeing net neutrality destroyed, the Trump administration immediately sued California after Gov. Like the 2015 Open Internet Order that was repealed in 2017, the bill also bans ISPs from charging websites to load for the ISPs subscribers or using the point where data enters the ISPs network to evade net neutrality. "We are confident that we will prevail in this case -because the facts are on our side". Thirty other states are debating net neutrality measures of their own.

"California should focus on ensuring that its [attorney general] can deploy that existing authority effectively, rather than wasting everyone's time on a lawsuit the state is sure to lose", Szóka said.
