U.S. Supreme Court sends Richland florist case back to state

The U.S. Supreme Court Monday handed a major religious liberty win to a Washington state Christian florist, vacating a lower court ruling that had required her to design an arrangement for a gay marriage ceremony. An appeals court reversed the decision, ruling for American Express.

The justices sent the case back in light of their decision earlier this month in a Colorado case in which a cakeshop owner denied service to a same-sex couple for their wedding.

Gay couple Robert Ingersoll and Curt Freed chose to sue Barronelle Stutzman, owner of Arlene's Flowers in Richland, Washington, when she refused to provide flowers for their 2013 wedding.

The Washington case centers around 73-year-old Stutzman, owner of Arlene's Flowers in Richland, Washington.

Last week, as WND reported, an OR couple forced to shut down its bakery because of crippling state fines for refusing to make a wedding cake for two women has appealed its case to the U.S. Supreme Court in light of the Phillips ruling. That court ruled against Stutzman, as did the Washington Supreme Court.

In Stutzman's case, the Washington State Supreme Court must now interpret whether she was treated fairly when the court first heard her case.

America hasn't heard the last of religious business owners who decline to create things for events that violate their beliefs.


The same court found similar faults with Texas state House of Representatives maps.

His lawyers said his confession, which was taped and aired in portions of the series, shouldn't have been used to convict him. The Supreme Court found that the evidence was "plainly insufficient" to prove that the 2013 Legislature acted in "bad faith".

The Supreme Court did find one state district, HD90, was an "impermissible racial gerrymander".

High court instructed that the case be reconsidered in light of the Masterpiece Cakeshop decision. "It is past time to put to rest these proliferating attempts to undermine the civil rights of LGBT people in the name of religion". The other dealt with religious exemptions from anti-discrimination laws for opponents of same-sex marriage.

"The hostility with which Bob Ferguson has treated Barronelle in unprecedented ways for his office do not bode well", Waggoner said. A three-judge panel of the U.S. Court of Appeals for the Seventh Circuit also sided with Dassey, but the case went to the full Seventh Circuit which reversed, ruling that state courts deserved "leeway" to declare the confession voluntary.
